Employee Document Requests
Pursuant to Labor Code sections 226(c), 432, and 1198.5, former employees, have the right to access all of payroll and time-keeping records, including, but not limited to, paystubs, daily and/or weekly time reports, timecards, payroll histories, personnel file(s), performance evaluations, documents relating to any discipline suffered, any documents signed, and other similar work place documents, including any investigatory file undertaken, and documents related to an employees termination.
Pursuant to Labor Code section 226(f), an employer must provide copies of an employees employment documents within 21 days of a request, otherwise, the employer will owe our client a penalty in the amount of $750.
